BOOKING TERMS AND CONDITIONS

Booking a Property is very different from booking a regular hotel room, especially with regard to payments and cancellations. Please read the following conditions carefully.

1. AGREEMENT

1.1 Wasabi Chalets Godou Kaisha (“Wasabi Chalets”) acts as a Property Management Company for Chalet owners (“Owner”). Each time a Guest confirms a booking of a Property through Wasabi Chalets, a Rental Contract is entered into between Wasabi Chalets and the guest in whose name the booking is made (the “Guest”) for the agreed period (“Rental Period”). 

1.2 Each time a Guest books a Property through Wasabi Chalets, the Guest is deemed to have agreed to these terms and conditions. The Rental Contract is not effective until Wasabi Chalets has confirmed the Guest’s booking in writing.

1.3 The person whose name appears first on the booking form shall be deemed to be the group leader and he/she shall be deemed to be the representative of the group, have authority to accept and does accept these terms and conditions on behalf of the group and be liable for the payment of all monies owed by all members of the group to Wasabi Chalets and to keep the group informed as required.

1.4 The “group” refers to all persons booked to stay in the accommodation listed on the booking and also includes any subsequent changes of names to the original booking.

2. BOOKING, DEPOSIT AND PAYMENT

2.1 Once availability has been confirmed by Wasabi Chalets, a booking will be held for five working days, pending receipt of the appropriate deposit.

  • A Minimum 50% deposit of the total booking price is due at the time of booking in order to secure the rental.

  • For booking requests with 10 weeks prior to rental period, the entire booking amount is due at the time of booking. 

2.2 If the required deposit and/or payment is not received within 5 working days, the booking will, at Wasabi Chalets’s sole election and without notice, be cancelled.

2.3 Notwithstanding clause 2.1 and 2.2 above, the outstanding balance (50%) is required to be paid to Wasabi Chalets ten weeks prior to the chalet hire commencing.

2.4 In certain circumstances the owners of the chalet require us to take a damage deposit.  We will advise you if this is necessary at the time of booking. 

2.5 All online payment, banking and transfer fees will be borne by the sender.  

3. PRICES

3.1 The prices stated on our website are in Japanese Yen (¥.) 

3.2 Wasabi Chalets guarantees the price of the accommodation as quoted at the time of booking and reserves the right to increase or decrease the price of unsold accommodation at any time. 

3.3 Subject to clause 3.2, the prices quoted are for the chalet hire and generally there are no other additional costs, surcharges, staff tips, or management fees above the total price quoted unless otherwise stated in the property description or the guest booking confirmation. Only an additional cleaning fee may be applicable, details of which will be communicated at the time of reservation. If the information in any of these is inconsistent, the most recently issued terms will prevail.

3.4 The price does not include travel, transfers, holiday and medical insurance, ski passes, childcare, equipment hire, ski lessons or meals etc.  

3.5  A security deposit may be required for certain properties.  If this is the case, you will be notified at the time of booking.

3.6 Once the Guest’s booking is confirmed, the price of the Guest’s reservation is fully guaranteed, even if Wasabi Chalets changes the price on its website after the Guest’s booking has been confirmed. In return for this commitment, no refunds will be made for any exchange rate fluctuations that would otherwise reduce the rental cost.

3.7  Wasabi Chalets reserves the right to impose any taxes or other charges which may be implemented by any government or other regulatory body, which were unknown at the time of publishing. Wasabi Chalets will tell the Guest promptly in the unlikely event that it becomes aware that any taxes or charges will apply to the Guest’s booking. All properties are subject to 10% sales tax. 

 

4. REFUND POLICY- CANCELLATION BY WASABI CHALETS

4.1 If through circumstances beyond our control Wasabi Chalets is forced to cancel your holiday a full refund is payable. This does not include events amounting to Force Majeure (Force Majeure meaning war, political unrest, weather, strikes, acts of God, epidemics, pandemics, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters or Government State of Emergency) or if you default in the payment of any sum payable to Wasabi Chalets on due date.

5. REFUND POLICY – CANCELLATION BY GUEST

5.1 You, or any member of your party, may cancel your chalet hire at any time provided that the cancellation is made by the group leader and received by Wasabi Chalets in writing.

5.2 The following cancellation charges apply: 

  • More than twenty four weeks before arrival: the 25% deposit. 

  • More than ten weeks before arrival: the 50% deposit. 

  • Within ten weeks of arrival: 100% of the total amount payable for the chalet hire.

  • For no-show: 100% of the total rental amount will be forfeited.

6. LIMITATION OF LIABILITY

6.1 Wasabi Chalets’s liability shall be limited to the chalet hire costs and under no circumstances shall it extend to additional loss or expenses incurred in or consequent to the holiday such as travel to and from the resort, pre-booked services, or ski passes.

6.2 Wasabi Chalets has no control over weather conditions, nor the forecasting or the reporting thereof. It is agreed Wasabi Chalets cannot guarantee the sufficiency or quality of snow or snow conditions and accordingly does not accept any liability for cancellation, curtailment or interruption of your trip of any kind as a consequence thereof or any factor/s over which it has no control or cannot reasonably foresee or cannot reasonably prevent . For the sake of clarity Wasabi Chalets does not warrant that the pistes located at or near the chalet you are hiring shall be open or suitable for skiing, snowboarding or other snow based activities and you agree that Wasabi Chalets shall not be liable to make any refund or to compensate you or your group nor arrange or pay for your or your group’s relocation or transport to an alternate resort.

6.3 Wasabi Chalets does not accept any responsibility or liability whatsoever in connection with any third party service provider or provision of third party services, as per section 10 (Third party activities and excursions) of these terms and conditions below.

7. WHOLE CHALET AND GROUP BOOKING

7.1 The chalets must be taken on a whole chalet booking basis only (part bookings may only be accepted at the discretion of Wasabi Chalets).

7.2 If for any reason part of the group cancels, the whole chalet hire booking price still applies as a minimum payment and must be paid by the remaining members of the group, unless agreed upon by Wasabi Chalets.

7.3 The Property and its facilities are available for the Guest’s full enjoyment during the Rental Period (excluding any staff or owner areas specifically deemed off-limits to guests.) However the Owner, Wasabi Chalets or other staff or contractors may need access to the Property from time to time (e.g. for maintenance purposes to the house, snow maintenance, utilities and services, or for the purposes of providing additional services requested by the Guest, etc.). The Guest is required to give them reasonable access to the Property for these purposes.

7.4 The number of persons (adults and children) staying at the Property must not exceed the confirmed number of guests indicated in the booking confirmation, unless specifically authorized in writing. Entry or access to the Property may be refused or limited where the number of guests exceeds the stated requirement and payment for extra guests will be enforced.

7.5 Wasabi Chalet requires at least 1 guest over the age of 25 years old to be part of the in-house guests. 

7.5 No pets are allowed unless agreed in writing in advance.

8. RESPONSIBILITY AND BEHAVIOR

8.1 All guests should act and behave in such a manner as to not affect or disrupt the enjoyment of other persons in the chalet or the local residents, or have a negative impact on the reputation of Wasabi Chalets or the Owners of the chalet.

8.2 Persons not booked into a chalet let by Wasabi Chalets may not stay overnight at the chalet without permission and without additional charges.

8.3 You and all members of your group and any guests shall adhere to the terms and conditions applicable to the chalet.

8.4 When a Guest books a chalet, you accept responsibility for the proper behavior of all the members of your group during your stay in the chalet. We reserve the right to terminate your stay and any of the members of your group whose behavior is such, in the reasonable opinion of the owner/agent or us, as likely to cause danger, upset or distress to anyone else or damage to property. In such event, no compensation or refund will be given and you shall be liable for any breakage, damage or loss suffered by the chalet owner and/or us as a consequence of your breach of these terms of business or a breach thereof by one of the members of your group in the chalet.

8.5 If you are in breach of these terms and conditions and/or the terms and conditions applicable to the chalet, we reserve the right to terminate your stay in the chalet and in such event we accept no responsibility for any damage or expense you or any member of your group may incur as a consequence of such termination.

8.6 Wasabi Chalets reserves the right to deal with and/or settle any claim it receives from the owner/agent of the chalet as regards, breakages, damages, loss or replacement (loss) in relation to a chalet or its contents, including the outside perimeter of the property, that occurs during or as a consequence of your stay as Wasabi Chalets, in its absolute discretion, think fit including settlement by way of an instant cash payment for any loss.

9. USE OF PROPERTY

 

9.1 All bookings are assumed to be for normal holiday purposes only, and the Guest agrees that the use of the Property will be limited to this purpose unless otherwise confirmed in writing.

9.2 If the Guest is planning to hold an event, such as a wedding or party, which involves having a larger number of people at the Property, or if the Guest is planning to use the Property for a purpose other than holiday, please communicate this to Wasabi Chalets at the time of booking, as special approval or arrangements may be required.

 

10. THIRD PARTY ACTIVITIES

10.1 Wasabi Chalets can assist in sourcing and booking many of the extra services and activities you need when on holiday.  In all cases, you will be contracting with the relevant service provider(s) directly and the relevant service(s) will be subject to the terms and conditions of those individual service provider(s). In no circumstances will these arrangements form part of your contract with us. Accordingly, our assistance in the sourcing or booking of such arrangements should not be construed as an endorsement or approval of such service provider or their services and we accept no responsibility or liability whatsoever for any such service provider or provision of services.

10.2 Any grievance with a third party service provider must be taken up with the relevant provider directly, pursuant to your contract with them.

11. LOST AND STOLEN PROPERTY

11.1 Whilst we will endeavor to assist, we accept no responsibility for items lost or left in the chalet that are not recovered or returned.

11.2 Wasabi Chalets cannot accept any responsibility for any theft, loss or damage of personal property during your holiday whether from within the chalet or not.

12. ARRIVAL/DEPARTURE TIMES

12.1 The chalet will be available to incoming guests after 15:00 pm on the date of arrival, although we will endeavour to have the chalet ready earlier if previously arranged and agreed by Wasabi Chalets.  Arrivals later than 22:00 will be self check-in only.

12.2 The chalet must be vacated on the day of departure by 10:00am.

12.3 For arrivals or departures outside of the check-in/ check-out times, arrangements may be made for holding luggage without extra charge.  

13. INDOOR SHOES

13.1 Please include slippers/indoor shoes as part of your packing as outdoor footwear is not permitted to be worn in the chalet.

14. SMOKING

14.1 Smoking is strictly prohibited indoors. To abide by Japan's fire regulations, and also for the health and safety of all guests, smoking is strictly confined to a designated outdoor smoking area for each chalet.

14.2 A ¥50,000 penalty for deep cleaning will be charged in case of any violations of smoking inside the chalet. The penalty will be applied each time any guest(s) is found smoking inside the chalet, or if any evidence of smoking is found.

 

15. CHILDREN

15.1 No matter how much care is taken, the chalets are not child proof. In the interests of safety, due care should be taken at the Property at all times. Suitable supervision should be given around roads, and when using all Property’s facilities. We will not be held responsible for any accidents occurring within the chalets, it is the parent’s responsibility to ensure their children are supervised at all times.

 

16. AMENDMENTS

16.1 Wasabi Chalets will do its best to accommodate any reasonable amendments, but the Guest should be aware that some changes may not be possible. Charges may also apply. Note: a shortening of stay for any reason is considered as a cancellation.

16.2 In the unlikely event that Wasabi Chalets is unable for any reason (including the sale of a property and force majeure) to provide the Guest with the Property booked by the Guest, Wasabi Chalets reserves the right to transfer the Guest and their party to an alternative Property of the similar type and value, in consultation with the Guest. If the price of the substituted Property is less than the original booking, the difference will be reimbursed to the Guest. If the price of the substituted Property is higher than the original booking, the difference may be charged to the Guest. If, however, after considerable effort by Wasabi Chalets, no alternative of similar type and value is available and / or no agreement can be reached between the Guest and Wasabi Chalets, then either Wasabi Chalets or the Guest may opt to cancel the booking and this Rental Contract. In that event, Wasabi Chalets will refund the Guest all monies paid, without further compensation.

 

17. TRAVEL INSURANCE

17.1 Outdoor Adventure Activities, such as Skiing can be a dangerous pursuit, therefore we recommend our Guests be fully insured before partaking in a skiing holiday. We do not sell nor do we arrange insurance and it is your and your group’s responsibility to ensure that the insurance arranged is appropriate for your needs.  

18. LAW AND JURISDICTION

The contract is made on the terms of these booking conditions and shall be subject to and governed by Japanese Law. All parties submit to the jurisdiction of the Japanese Courts at all times.
